《劳动合同法》的实施:问题和对策建议

    摘要: 通过对城市劳动力调查数据的分析表明,《劳动合同法》的实施中主要存在三个问题:一是劳动力对《劳动合同法》的认知度还比较低;二是仍然有相当比例的劳动力未与用人单位签订劳动合同;三是外来劳动力与城市本地劳动力的劳动合同签订率差异较大。针对这些问题,应加强宣传,普及和解释好《劳动合同法》;严格监督《劳动合同法》的执行;更好地实施《劳动合同法》,并进行彻底的户籍制度改革。

    The Implementation of China's Labor Contract Law: Problems and Policy Suggestions
    Abstract:  Through analyzing China Urban Labor Survey data,this paper finds that there mainly exist three problems with the implementation of Labor Contract Law.Firstly,workers' awareness of Labor Contract Law is still pretty low.Secondly,a large share of workers have not signed contract with their employers.Thirdly,there exists a big difference on the rates of signing contracts between migrant and urban local workers.The dissemination of Labor Contract Law should be strengthened.The Law should be better implemented and its implementation should be strictly supervised.The household registration system should be reformed further.
